On September 13, 2022, Shellsburg couple, Jeffrey Diveley, 65,and Stacy Diveley, 49, were first arrested on several crimes involving children. Records indicate that he is currently serving a prison sentence, at the Iowa Medical & Classification Center in Coralville. (See second story about him HERE.)

Future Case

The Diveley couple was also arrested on July 8. 2024 in another set of charges involving children. That case is scheduled for 2026.

In the second set of arrests, Jeffrey is facing five additional charges, including:

-Child Endangerment with bodily injury, a Class D Felony

-Four charges of Lascivious Acts with a Child, a Class C Felony.


Stacy's charges are a bit lesser in the first charge:

-Child Endangerment, an aggravated misdemeanor

-Four counts of Lascivious acts with a child, a Class C Felony


Current Case
Stacy Diveley, faced four misdemeanor counts of Child Endangerment, and two Class D Felony charges of Child Endangerment with Bodily Injury as well as a charge of Witness Tampering. Diveley was found guilty in six of these charges. In the closing arguments, the prosecutor made it clear that there was evidence that Diveley was guilty of the same crimes, multiple times more than what she was charged.  

Charges and sentencing included:
Count 1 - Child Endangerment, Aggravated Misdemeanor,
                2 years, concurrent
Count 2 - Child Endangerment, Bodily Injury, Class D Felony,
                downgraded to an Aggravated Misdemeanor by the jury
                2 years, concurrent
Count 3 - Child Endangerment, Aggravated Misdemeanor,
                2 years, concurrent
(Concurrently and consecutively to counts 4,5,6)
Count 4 - Child Endangerment, Bodily Injury, Class D Felony,
                5 years,
(Consecutive with 1,2,3)
(Concurrent to 5 and 6)
Count 5 - Child Endangerment, Aggravated Misdemeanor,
                2 years, concurrent
Count 6 - Child Endangerment, Aggravated Misdemeanor,
                2 years, concurrent
(5 and 6 Consecutively to each other)
Count 7 - Tampering with witness or juror, Aggravated Misdemeanor,
                dismissed by the jury
Count 8 - Contempt, Failure to pay amounts, contempt of court

In layman's terms:
  • Counts 1, 2, and 3 (2 years each) served concurrently, resulting in 2 years.
  • Counts 4 (5 years), 5 (2 years), and 6 (2 years) served concurrently, resulting in 5 years.
  • The 2-year group (Counts 1, 2, 3) is served consecutively to the 5-year group (Counts 4, 5, 6), totaling 7 years.

  • The jury did not find sufficient evidence to convict Diveley on the seventh charge of tampering with a witness and ruled her innocent.  Another charge of contempt for failing to pay fines and/or fees. on November 18, 2024. She will serve no more than seven years and will be eligible for parole.

    Finally in Prison
    Her original sentencing was on July 1, 2024. At the time of sentencing, she was not taken directly into custody as normal, but was released. It is believed that it was due to filings by Diveley's lawyer. Last week she announced on her Facebook page that she was required to check into jail. The angry post read, "I hope they're happy that their lies have destroyed and taken my life! I hope that they are all f***** happy!" referring to the victims involved in the first case.

    She shared a photo of two of the directives given for serving her jail time which include instructions for self-surrendering. She was ordered to report by 12:00 p.m. on Wednesday, October 1, 2025, 14 months later. 

    She was finally booked in on October 9, 2025 around 5:30 a.m. following a brief hospitalization. She will be serving her time at the Iowa Correctional Institution for Women in Mitchellville.

    Just an FYI:

  • Iowa law, charges are separated between misdemeanors and felonies:
  • -Misdemeanors can be punishable up to two years in jail.
    -Felonies are put into one of four classes with Class A Felonies as the most serious
    and Class D as the least serious.
    -Sentencing for Class D felonies can bring up to five years in prison and a fine between $750 and $7,500. There is no mandatory prison term.

They are now succinct time but are going to be serving much more with the other charges that they are going to be found guilty of. He will never get out and if she ever sees daylight on the outside she will have to be on the registry...
    Kids are much safer now.
    To those that are defending them... you are as sick as them.
    DM October 10, 2025, 9:40 pm Facts are facts! I know 1st hand what happened! I was in the courtroom, saw and heard all testimony and EVIDENCE! Messages to SD from said victims where victim is basically begging her to help them, confronting SD about the abuse. SD acknowledged the abuse in those messages. She is NOT a loving mother. A mother protects children. SD has lied to everyone to make herself the victim. She is not! She knew about the abuse and did nothing! And those of you that are sticking up for her, shame on you! I know a few of you were there and heard and saw all the evidence against them as well. How the hell can you have her back and turn it on those beautiful children.
