The Benton County Board of Supervisors met in regular session with Supervisors Seeman, Primmer and Bierschenk present. The meeting was called to order at 9:00 a.m. at the conference room at the Benton County Service Center. Members of the public were provided the zoom access capability to join in during open session and livestream at https://www.youtube.com/bentoncountyiowa. Unless otherwise noted, all actions were approved unanimously. Bierschenk moved/Primmer seconded: To approve the minutes of Tuesday, September 13, 2022. Motion carried.

Primmer moved/Bierschenk seconded: To approve Class C Liquor License for Beyonder Resort at Lazy Acres Campground effective September 5, 2022 through September 4, 2023. Motion carried.

Primmer moved/Bierschenk seconded: To approve the first-tier canvass of the September 13, 2022 Special School Election for Benton Community Schools as read and declare the public measure in Benton County as failed with 429 no votes and 375 yes votes. Benton County is the control county for Benton Community Schools but they have some voters in Iowa and Tama County, so there will have a 2nd tier canvass to declare the final results next week. Motion carried.

Primmer moved/Bierschenk seconded: To approve Resolution #22-83, Abatement of Taxes that Benton County acquired 8 parcels for right of way purposes in the total amount of $332.00. Motion carried.

Primmer moved/Bierschenk seconded: To approve Resolution #22-84, Committed Fund Balances as of June 30, 2022 in accordance with GASB 54 General Fund-$622,000, Rural Services Fund-$32,000, Conservation Land Acquisition-$138,342, EMS Revolving Loand Fund-$123,643 and LOSST Fund of $115,000. Motion carried.

Primmer moved/Bierschenk seconded: To approve Resolution #22-85, National Voter Registration month/day is September 20, 2022. Motion carried.

The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing Korinda Eastwood in a part of SW ¼ of the NW ¼ of Section 29-85-9. Eldon Neighbor, land owner was present to answer any questions that may arise. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Eastwood would like to build a new home. The average CSR is a 23. The potential site will need a new driveway along with a new well and septic. Legal notices were published and adjacent owners were notified. There was notice from two prior to today's meeting, but nothing in opposition, just inquiries. The overall pattern of the area is farming. After no further discussion the public hearing was closed.

Bierschenk moved/ Primmer seconded: To approve the land use hearing change for Korinda Eastwood in part of the SW ¼ of the NW ¼ of Section 29-85-9. Motion carried.

The time of 9:30 a.m. having arrived, and this being the time and date for the second consideration on Ordinance #78, An Ordinance readopting the existing Benton County Code of Ordinances and/or repealing certain portions therein. The board took up the matter. There was no other comments or questions in regards, so the public hearing was closed.

Primmer moved/Bierschenk seconded: To approve the second consideration of Ordinance #78, An Ordinance readopting the existing Benton County Code of Ordinances and/or repealing certain portions therein and waiving the second consideration. Motion carried.

Committee reports and talk of an open records request was had. Also a reminder of the Heartland Risk Insurance seminar to be held Thursday, September 22, 2022.

Clay McBride was present to answer any questions the board may have regarding the new liquor license requests. This is a new concept in Iowa with a mobile trailer with 10 taps. The person has to scan an ID to get a bracelet before the taps will serve at private events. With McBride's not owning the premises they have to go through the state for licensing for these events.

Primmer moved/Bierschenk seconded: To approve (5) 5-day Class B Liquor Licenses for McBride Mobile Taps for September 30, 2022- October 4, 2022, October 7-11, 2022, October 14-18, 2022, October 21-25, 2022 and October 28, 2022 through November 1, 2022 located at 2515 55th Street, Kacena's Pumpkin Farm. Motion carried.

Bierschenk moved/Primmer seconded: To approve Resolution #22-86, Speed Limit on 27th Ave. Dr. to "40 mph on 27th Avenue Drive from the intersection of 55th Street Drive south 0.75 miles to the intersection of 56th Street Drive." Motion carried.

Primmer moved/ Bierschenk seconded: To authorize a few changes and approve the Abbe Center Lease of a room at the Benton County Service Center for a term of three years. Motion carried.

Primmer moved/Bierschenk seconded: To adjourn. Motion carried.
