​The Benton County Board of Supervisors met in regular session with Supervisors Bierschenk and Seeman present, Supervisor Primmer met via phone. The meeting was called to order at 9:00 a.m. at the Benton County Service Center's conference room. Members of the public were provided the zoom access capability to join in during open session and watch live at the county's YouTube channel. Unless otherwise noted, all actions were approved unanimously.

​Seeman moved/Primmer seconded: To approve the minutes of Tuesday, December 1, 2020. Motion carried.

Primmer moved/Seeman seconded: Approve claims numbered 237280 through 237408, payroll checks numbered 141647 through 141663, ACH deposits numbered 43821 through 43954, vendor checks 237409 through 237416. Motion carried.

Seeman moved/Primmer seconded: To adopt Resolution 20-82, 2021 Benton County Multi-Jurisdictional Local Hazard Mitigation Plan. Motion carried.

​Board discussed moving the meeting on December 29th. Board decided to postpone it if there was nothing pressing on the agenda.

The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing for Brent & Amy Allee a part of the NW1/4 of the NE1/4, Sec 15 T85N R9W. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Allee's would like to build a new single-family dwelling on one acre of land that they own at this location. The proposed building site is south of 58thStreet. The land under review is grass, with a CSR of 21. A new proposed driveway has been reviewed and compliant. The sight will need a new septic and well. The proper notice was given to 6adjacent land owners and heard from one regarding hunting. Greenlee question Pat Jorgensen with Iowa Department Natural Resources regarding the concerns to the 200 yards of an inhabited dwelling and no shoot rules. Jorgensen informed that Iowa Code Chapter 481A.123 subsection 5, addresses this issue. "This section does not apply to the discharge of a firmarm on a farm unit by the owner or tenant of the farm unit or by a family member of the owner or tenant of the farm unit." Seeman questioned if Allee's were notified of the questions and concerns regarding hunting, Greenlee stated they were notified and understood the Code Section. No other comments were heard, and the public hearing was closed.

​Primmer moved/Seeman seconded: To approve the land use hearing for Brent & Amy Allee a part of the NW1/4 of the NE1/4, Sec 15 T85N R9W. Motion carried.

The time of 9:30 a.m. having arrived, and this being the time and date for a land use hearing for Kevin Gilbrealth a part of Parcel A, in the SW1/4 or the SW1/4, Sec 29, T83N, R10W. Gilbreath has a truck repair business that he has been doing from this location in an existing building that has not been approved previously. One of the buildings on his property, the one to the north end of the acreage, was destroyed in the derecho, and the house was severely damaged, and that will be rebuilt. Gilbrealthneeds to temporarily move the residence into the shop building. This is where he was conducting his business. In the process of changing things around on his property he needed to install a new septic system for the building they were going to occupy. There is no land in production. As the building is going to be back where an original building was, on the original farmstead, CSR is not relevant. No other comments were heard, and the public hearing was closed.

​Seeman moved/Primmer seconded: To approve the land use hearing for Kevin Gilbrealth a part of Parcel A, in the SW1/4 or the SW1/4, Sec 29, T83N, R10W. Gilbreath. Motion carried.

​City of Shellsburg Mayor, Lonnie Speckner met with the board regarding abating taxes on a property the city owns. The city bought the property on July 11, 2018 with the intent of tearing the house down and using the property for a parking lot. The house was taken down within the last month. There is a garage still on the property that the city is using for storage. The city assumed that since they took over the property that they didn't have to pay taxes. Speckner contacted the County Assessor office and they stated the city would have to go thru the Board of Supervisors to abate the taxes. Seeman stated he would like to table the decision until the County Assessor is contacted so that the board don't set a precedence. Item is to be placed on December 15, 2020's agenda.

​Primmer moved/Seeman seconded: to accept bids from IDOT November letting for Bridge Replacement Bundle Projects [BROSCHBP-C006(110)--GA-06 and BROSCHBP-C006(117)-NC-06 and BRS-CHBP-C006(115)-GB-06 and BROSCHBP-C006(116)-GA-06 and BROSCHBP-C052(123)---NC-52]. Motion carried.

​Seeman moved/Primmer seconded: To award bridge replacement project bundle to Taylor Construction, Inc. in the amount of $2,531,704.50. Motion carried.

​Primmer moved/Seeman seconded: to adopt Resolution #20-83 Designate County Engineer to execute contract for Bridge Replacement Bundle Projects for Proposal 06-C006-110 [BROSCHBP-C006(110)--GA-06 and BRS-CHBP-C006(115)--GB-06 and BROSCHBP-C006(116)--GA-06 and BROSCHBP-C006(117)--NC-06 and BROSCHBP-C052(123)--NC-52 . Motion carried.
