The Benton County Board of Supervisors met in regular session with Supervisors Primmer, Bierschenk and Seeman present. The meeting was called to order at 9:00 a.m. Members of the public were provided the zoom access capability to join in during open session and watch live at the county's YouTube channel. Unless otherwise noted, all actions were approved unanimously. Summarized Resolutions will be available in the Auditor's office and at: www.bentoncountyiowa.org

Bierschenk moved/Seeman seconded: To approve the minutes of Tuesday July 21, 2020. Motion carried.

Moved/seconded: To set land use hearing date of Tuesday August 25, 2020 at 9:15 a.m. for Chris and Julie Frimml for part of Parcel C in SE ¼ SE ¼ of 10-83-10. Motion carried.

Seeman moved/Bierschenk seconded: To approve Resolution #20-51, Abatement of Taxes in the amount of $1,546.00 on parcel # 240-88600. Motion carried.

The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing for David and Mary Paustian in part of NE ¼ NE ¼ of 31-85-9. Land Administrator Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Paustians were in attendance and would like to propose a change on the use of 5 acres to allow for a wine production facility at their residence located within existing attached garage. They would like to add an addition on to this, and if so the driveway would need to be widened. The lots are located within the "Terrace Green Estates" Sub Division" with restrictive covenants. Greenlee presented a document that approved changes for the lots in question, signed by people in the development. It also allows for signage and special events. Hearing no other further comments, the public hearing was closed.

Bierschenk moved/Seeman seconded: To approve the land use change for David and Mary Paustian in part of NE ¼ NE ¼ of 31-85-9 and for the amended covenants to also be recorded along with the compliance certificate. Motion carried.

Weed complaint was already handled, so they won't be in attendance.

Other committee reports were discussed, along with looking over the East Central Iowa Local workforce development shared liability agreement, the board decided to wait and get the county attorney's opinion. So no action was taken with that.

Bierschenk moved/Seeman seconded: Authorize claim #235976 for payment to Stark Construction for work done on the new transportation building in the amount of $22,500 Motion carried.

Seeman moved/Bierschenk seconded: To approve purchase agreement for temporary and permanent easement for bridge replacement project #BROS-SWAP-CO06(114) for Matthew & Connie Hobson in the amount of $5,000.00 for 1.91 Acres. Motion carried.

Seeman moved/Bierschenk seconded: To approve purchase agreement for bridge replacement project #STPS-CO06(108)-SE-06 with Lubbocks for .47 Acres for $3,465.00. Motion carried.

Seeman moved/Bierschenk seconded: To enter closed session at 10:02 a.m. pursuant to Iowa Code 21.5(1)k. Motion carried.

Seeman moved/Bierschenk seconded: To exit closed session.

Bierschenk moved/Primmer seconded: To follow the CDC Guidelines provided and adjust with changes that follow for all Benton County Facilities. Motion carried.

Bierschenk moved//Seeman seconded: To adjourn. Motion carried.
