The Benton County Board of Supervisors met in regular session with Supervisors Bierschenk and Seeman present, Primmer participated via zoom, and Bierschenk acted as Chair and called the meeting to order at 9:00 a.m. Members of the public were provided the zoom access capability to join in during open session and watch live at the county's YouTube channel. Unless otherwise noted, all actions were approved unanimously.
Seeman moved/Bierschenk seconded: To approve the minutes of April 28, 2020. Motion carried.
Primmer moved/Seeman seconded: To approve Tier 1 Environmental Assessment for Community Block Grant through the IEDA for watershed improvements specific to Tier 2 Review and approve the proper notices for the paper. Motion carried.
Seeman moved/Primmer seconded: Approve and sign the intent to obligate construction funds and affirmation of duplication of Benefits subrogation for CDBG Grant Project for the Middle Cedar Bid Pack 4. Motion carried.
Randy Janssen from Janssen Waterproofing updated the board on the findings for additional courthouse repairs needed and had brought estimates and pictures of the concerned areas. Copper flashing is needed on top of the pediment on the south elevation about the south entrance and will include gable sides and stone piers of the pediment. Along with some windowsills to the outer edge of the banister.
Primmer moved/Seeman seconded: To approve the additional work in the total amount of $40,179.00 with Janssen Waterproofing, Inc. along with D & S Sheetmetal, Inc. Motion carried.
Primmer moved/Seeman seconded: To approve the public notices for roadside spraying which will begin May 13, 2020 and also the notice to organic farmers and vineyards who need to notify the county if they don't want the spraying. Motion carried.
Seeman moved/Primmer seconded: To approve Resolution #20-29, Destruction of Noxious Weeds. Motion carried.

DESTRUCTION OF NOXIOUS WEEDS
Be It Resolved by the Board of Supervisors of Benton County, Iowa that pursuant to the provisions of Chapter 317, Code of Iowa, it is hereby ordered:
1. That each owner and each person in the possession or control of any lands in Benton County shall cut, burn or otherwise destroy all noxious weeds thereon, as defined in this chapter, at such times in each year and in such manner as shall prevent said weeds from blooming or coming to maturity, and shall keep said lands free from such growth of any other weeds as shall render the streets or highways adjoining said land unsafe for public travel. Noxious weeds shall be cut or otherwise destroyed on or before June 1, 2020 and as often thereafter as is necessary to prevent seed production:

2. That each owner and each person in the possession or control of any lands in Benton County infested with any of the following noxious weeds shall adopt a program of weed destruction described by the Weed Commissioner, which may be expected to destroy and will immediately keep under control such infestations of said noxious weeds.
(a) Primary Noxious Weeds: Quackgrass, Perennial Sowthistle, Canada Thistle, Bull Thistle, Musk Thistle, European Morning Glory or Field Bindweed, Horsenettle, Leafy Spurge, Perennial Peppergrass, Russian Knapweed, Buckthorn, Tall Thistle and all other species of thistles belonging in general of Cirsium and Carduus, Palmer Amaranth.
(b) Secondary Noxious Weeds: Butterprint, Cocklebur, Wild Mustard, Puncturevine, Teasel, Wild Carrot, Buckthorn Plantain, Sheep Sorrel, Sour Dock, Smooth Dock, Poison Hemlock, Wild Sunflower, Multiflora Rose and Shattercane.
3. That if the owners or persons in possession or control of any land in Benton County fail to comply with the foregoing orders, the Weed Commissioner or his designee shall cause this to be done and the expense of said work, including costs of serving notice and other costs, if any, shall be assessed against the real estate.
4. That the County Engineer is hereby directed to cause notice of the making and entering of the foregoing order by one publication in each of the official newspapers of the County.

Primmer moved/Seeman seconded: To authorize and approve signature of the transportation building contracts with Edwards Plumbing and Heating, G & H Electric, Stark Construction, Pickering Backhoe and Worthington Concrete. Motion carried.
Seeman moved/Primmer seconded: To approve and sign the builder's risk insurance coverage in the amount of $1,231.00 with Gallagher Risk Insurance for the construction of the new Transportation Building. Motion carried.
Primmer moved/Seeman seconded: Approve utility permit for East Central Iowa REC in Harrison Township. Motion carried.
Primmer moved/Seeman seconded: To approve IDOT agreement for County Bridge Federal-Aid-SWAP funding for Bridge on D5, West of Mt. Auburn. Motion carried.
Primmer moved/Seeman seconded: To approve for the purchase of heavy equipment low boy trailer for secondary roads. Motion carried.
Engineer also provided an update on the right of way acquisition for bridge in Florence Township on 75th Street.
Supervisor Primmer reported about items left at the recycling container in Shellsburg and how items being left aren't recyclable. This will be on for further discussion next week. Primmer also reported on the record number of people at the food pantry and challenges from fewer volunteers to help due to health concerns and protecting people waiting outside during bad weather.
