The Benton County Board of Supervisors met in regular session with Supervisors Bierschenk and Seeman were present. Supervisor Primmer called in periodically throughout the meeting. Bierschenk called the meeting to order at 9:00 a.m. Unless otherwise noted, all actions were approved unanimously.
Seeman moved/Bierschenk seconded: To approve the minutes of March 3, 2020. Motion carried.
Seeman moved/Bierschenk seconded: Approve payroll checks numbered 141160 through 141199, ACH deposits numbered 40973 through 41111 , vendor checks 234444 through 234450 claims numbered 234451 through 234593. Motion carried.
Seeman moved/Bierschenk seconded: To approve Resolution # 20-17, Gifting LOSST funds to Cedar Mt. Auburn Fire Department.
RESOLUTION #20-17
WHEREAS, the Benton County Board of Supervisors has established a program for gifting funds to emergency service providers who provide services within the unincorporated area of Benton County; and
WHEREAS, the Cedar Mt. Auburn Fire Department has requested a gift of funds; and
WHEREAS, the Cedar Mt. Auburn Fire Department provides emergency services to areas in Cedar Township, City of Mt. Auburn and mutual aid to other surrounding townships;
WHEREAS, the Cedar Mt. Auburn Fire Department has provided invoices totaling 20,000 for the purchase of an emergency response truck; and
WHEREAS, the Cedar Mt. Auburn Fire Department agrees that the vehicle obtained with the proceeds of this gift shall be used when necessary for rural fire protection and/or life support operations, consistent with the intended use of the money from the Local Option Sales and Services Fund,
NOW THEREFORE BE IT RESOLVED that the Benton County Board of Supervisors approves an Emergency Services Gift to the Cedar Mt. Auburn Fire Department in the amount of $2,000.00 which represents ten percent of the total purchase price for equipment.

The time of 9:15 a.m. having arrived, and this being the time and date for a land use hearing for Zach Ellis in part of the SE1/4 NW1/4 of 3-85-9. Zach Ellis was present along with numerous concerned neighbors and citizens. Marc Greenlee presented the technical information with the Benton County Agricultural Land Use Preservation Ordinance. Ellis plans to use the land for a new building on his owned parcel where he would move his business. The business is manufacturing corrugated boxes. The driveway met the required criteria and can be widened. CSR is 56 with surrounding use being farm ground. Adjacent owners were notified, and those present voiced their concern on the safety issues and the preservation of ag land as described in Benton County's land use ordinance. Neighbor Joyce Wyckoff spoke on her safety concerns due to increased traffic this could cause and the dust it could create being along a curve and a semi backing into a driveway. Other nearby residences spoke on traffic concerns as well as noise and if there was an expansion on the facility in the future, and the deterioration of the gravel road this could cause. Mentioning there is an industrial area where development should occur. Land Use Administrator Marc Greenlee stressed there is control on what can be done with the building, if the land is sold, the building would have to continue to be used for the approved specific intended use as proposed by Ellis. Any other use would need to be approved by the Board of Supervisors. Seeman and Bierschenk agreed they would like to go see the driveway in person and make sure things are done in a safe manner.
Seeman moved/Bierschenk seconded: To table action on land use hearing for Zach Ellis in part of the SE1/4 NW1/4 of 3-85-9 for Tuesday, March 17, 2020 at 9:05 a.m. Motion carried.
Matt Boggess, Vinton Park and Recs Director along with Chris Ward, City of Vinton Administrator spoke about using the county right of way for a bike and walking trail and using courthouse lawn for some upcoming events. Myron Parizek, County Engineer will look at the route to field concerns and questions since a portion of the walking trail is on county property.
Seeman moved/Bierschenk seconded: To approve use of courthouse lawn application from the Vinton Park and Recreational Department for June 18, 2020 and October 31, 2020. Motion carried.
Election Deputy Gina Edler and the board proceeded with canvassing the March 3, 2020, Special City/School Election. Andrew M. Elwick of City of Vinton Council District 2 was declared the winner.
Seeman moved/ Bierschenk seconded: To declare the canvass of the Special City/School Election to be complete and the votes cast to be official. The official results are to be recorded in the office of the County Auditor. Motion carried.
Seeman moved/Bierschenk seconded: To approve utility permit for East Central Iowa REC to bore under the county right of way in Canton Township. Motion carried.
Seeman moved/Bierschenk seconded: To approve utility permit for Northern Natural Gas in Bruce Township. Motion carried.
Seeman moved/Bierschenk seconded: To approve utility permit(s) for Poweshiek Water Association in Leroy and Florence Townships for new residences. Motion carried.
Seeman moved/Bierschenk seconded: To approve IDOT agreement No: 6-20-HBP-SWAP-013 for County Bridge Federal-aid SWAP funding on Project BROS-SWAP-CO06(98)-SE-06. Motion carried.
Seeman moved/Bierschenk seconded: To approve IDOT Federal-aid agreement No: 6-20-CHBP-003 for Competitive Highway Bridge Program on project Numbers: BRS-CHBP-CO06(115)-GB-06, BROSCHBP-CO06(117)-NC-06, BROSCHBP-CO06(110)-GA-06 and BROSCHBP-CO06(116)-GA-06. Motion carried.
Seeman moved/Bierschenk seconded: To Approve Cooperative 28E Agreement between Benton County and Johnson County for a Competitive highway Bridge Program (DHBP) Projects approved. Motion carried.
