The Benton County Board of Supervisors met in regular session with Supervisors Seeman, Tippet were present, Volz joined via telephone.

Chairman Seeman called the meeting to order at 8:45 a.m. at the Benton County Service Center. Members of the public are invited to join in during open session or watch the livestream at https://www.youtube.com/bentoncountyiowa.

Tippett moved/Volz seconded: To approve the minutes of Tuesday, June 16, 2026. All members voting aye. Motion carried.

Tippett moved/Volz seconded: To approve the 6/18/2026 payroll checks numbered 144091 through 144157, ACH Deposits 65717 through 65890 and vendor checks 257707 through 257714 and claims numbered 257715 through 257920.Tippett, Seeman and Volz voting aye.

Tippett moved/Volz seconded: To set public hearing date of Tuesday, July 21, 2026 at 9:15 a.m. for a non-agricultural use for Farmtastic 3, LLC within the NE ¼ of the NE ¼ and the SE ¼ of the NE ¼ of Section 12-86-11. Tippett, Seeman and Volz voting aye. Motion carried.

Volz moved/Tippett seconded: To approve Resolution #26-56, FY27 Certifications of deputies in the Auditor's, Recorder's, Treasurer's, Sheriff's and Assistants in the County Attorney's office. Tippett, Seeman and Volz voting aye. Motion carried.

RESOLUTION #26-56 CERTIFICATION OF DEPUTY SALARIES FOR FY27

WHEREAS, Iowa Code 331.904(1) states that the auditor, treasurer, and recorder shall certify the annual base salary of the deputies in the auditor's, recorder's, and treasurer's office pursuant to said code section; and

WHEREAS, Iowa Code 331.904(2) states that the sheriff shall certify the salaries of the first and second deputies within his department pursuant to said code section; and

WHEREAS, Iowa Code 331.904(3) states that the county attorney shall set the salaries of the assistant county attorneys pursuant to said code section; and

WHEREAS, the salaries of the deputies and assistants of the auditor, treasurer, recorder and sheriff, have been certified by the principal officers to the board of supervisors; and

WHEREAS, the base salaries will not exceed the limitations specified in Iowa Code for the deputies in the auditor's, treasurers, recorder's and sheriff's departments; and

WHEREAS, Iowa Code 331.904 states that the Board shall certify the salaries to the county auditor if the salaries are within the budgets set for the auditor, treasurer, recorder and sheriff,

NOW THEREFORE BE IT RESOLVED by the Benton County Board of Supervisors that the following salaries for deputies and assistants in the respective offices be certified to the county auditor:

Gina Edler - 85% of the principal officer

Jonathon Martin-67 % of the principal officer

Recorder's Office:

Marla Sutton-85% of the principal officer

Tippett ______________________________________ Bruce Volz Tippett moved/Volz seconded: To authorize Derek Marsh, to file a petition on behalf of the Benton County Board of Supervisors to intervene with the Iowa Utilities Commission regarding docket #GCU 2026-0002 in regards to the Alliant Energy's proposed project. Globe Life Liberty National Insurance representatives presented what they have to offer for supplemental employee benefits pre-taxable. They provided a folder and briefly explained the programs offered. Seeman moved/Tippett seconded: To approve Resolution #26-57, Variance to the Sub-Division Ordinance. Tippett, Seeman and Volz voting aye. Motion carried. RESOLUTION #26-57 VARIANCE TO THE BENTON COUNTY SUBDIVISION ORDINANCE WHEREAS, Benton County adopted the Benton County Subdivision Ordinance #61, as amended by Ordinance #72; and WHEREAS, said ordinance regulates the subdivision of land; and WHEREAS, said ordinance sets forth the minimum requirements and improvements for subdivisions created in the unincorporated area of Benton County; and WHEREAS, a request has been presented to the Board of Supervisors by Thomas & Jonna Darland to waive the required provisions in Article IV, Sections 4.01 through 4.05; Article V, Sections 5.04 through 5.07; Article VI, Sections 6.01(a), 6.02 through 6.03, and 6.05(f); and Article VII, Section 7.01 of the ordinance to allow for a property line adjustment within the North ½ of the SW ¼ of the SW ¼ of the NW ¼ and the SW ¼ of the NW ¼ except the SW ¼ of the SW ¼ of the NW ¼ all within Section 15, Township 86N, Range 10W. NOW THEREFORE BE IT RESOLVED by the Benton County Board of Supervisors that the requirements of Ordinance #61, as amended by Ordinance #72, are hereby waived as stated for the division of real property located within Lots 10 & 11 of Lodge Log Estates to Benton County, Iowa. Tippett, Seeman and Volz voting aye. Motion carried. Discussion followed up from last week regarding House File 2490, regarding public posting for public notices. Auditor Rippel brought this up last week and needed formal action since it goes into effect July 1, 2026. Rippel provided some examples and costs for outdoor display cases. Tippett moved/Volz seconded: To approve Resolution #26-58, Designating the official physical location for posting public meeting notices temporarily be located on the south doors until a permanent structure can be installed. Tippett, Seeman and Volz voting aye. Motion carried. RESOLUTION #26-58 RESOLUTION DESIGNATING THE OFFICIAL PHYSICAL LOCATION FOR POSTING PUBLIC MEETING NOTICES WHEREAS, Iowa Code Chapter 21 requires governmental bodies to provide notice of the time, date, and place of each meeting and the tentative agenda thereof; and WHEREAS, House File 2490, effective July 1, 2026, requires governmental bodies to designate a location for posting notices that is visible and accessible to the public at all times; and WHEREAS, the Benton County Board of Supervisors finds it necessary to designate an official physical location for the posting of meeting notices and agendas in compliance with Iowa law; NOW, THEREFORE, BE IT RESOLVED by the Benton County Board of Supervisors that: 1. The official physical location for the posting of notices and agendas for meetings of the Benton County Board of Supervisors shall temporarily be the exterior south door until a weather proof bulletin board can be purchased and located at the west entrance of the Benton County Courthouse, 111 E 4th Street, Vinton, IA 52340, which is accessible and visible to the public twenty-four (24) hours per day; 2. Meeting notices and agendas shall also be posted on the County's official website, when applicable, in accordance with Iowa Code Chapter 21. 3. Any amended agenda shall be clearly identified as "AMENDED", and the specific item or items that have been added, removed, or modified shall be identified in accordance with Iowa law. 4. This resolution shall remain in full force and effect until amended or repealed by subsequent resolution of the Board. PASSED AND APPROVED this 23rd day of June, 2026.
